Key information before purchase

One-time payment, price includes VAT where applicable, immediate digital access, no subscription. The customer must separately accept the terms and request immediate performance.

1. Seller and project

The Drum Essentials is a project developed by Elias Luyckx within Smart’s shared enterprise. The contractual seller stated for sales authorised by Smart is Productions Associées ASBL, acting for The Drum Essentials.

2. Products and compatibility

Products are digital educational content comprising private pre-recorded videos, PDF documents and sheet music. They require an internet connection, a verified email address, an account compatible with the site authentication, a recent web browser and a PDF reader. PDF files can be downloaded. Videos are viewed using the private links supplied in the program.

The purchase grants a personal, non-exclusive and non-transferable licence. Lifetime access means that no recurring subscription is charged for the purchased product. This wording does not restrict the consumer’s statutory rights.

3. Price, VAT and payment

Prices are displayed in euros and include VAT where applicable. The final total and tax details applicable to the customer’s location are shown before payment. The Drum Essentials adds no administration fee. Stripe processes the secure payment and card data.

4. Order process

  1. The customer selects a program and reviews its features, price and compatibility.
  2. They review the summary, accept the terms and give express consent to immediate access.
  3. They review their details, total and taxes on Stripe, then use the button that clearly indicates payment.
  4. After confirmed payment, confirmation is emailed on a durable medium and access is linked to the order email address.

The contract may be concluded in French or English. The order and its references are archived in the payment and management systems required for performance. The customer can retrieve purchases from their account.

5. Delivery and customer account

Access begins after payment confirmation. A secure Clerk session with a verified email address exactly matching the order email is required. If delivery or access fails, the customer must use the contact form so the seller can restore conformity.

6. Immediate access and withdrawal

A consumer normally has 14 days to withdraw from a distance contract. For digital content not supplied on a tangible medium, that right ends only when performance has begun after the consumer’s prior express consent and acknowledgement that the right of withdrawal is lost. Both elements are collected before payment and confirmed by email.

If these statutory conditions are not met, the withdrawal rights provided by law remain applicable. A clear statement may be sent through the contact form or by email, stating the name, order email, payment reference, product and decision to withdraw.

7. Statutory conformity guarantee

Digital content and services benefit from the statutory conformity guarantee. In the event of a defect, the consumer may request that conformity be restored. Where this is impossible, refused or disproportionate under the statutory conditions, the consumer may request a price reduction or termination of the contract. Nothing in these terms limits this guarantee.

8. Intellectual property

Videos, text, sheet music, illustrations and other materials remain protected. Reproduction, resale, public distribution, account sharing or distribution of private links is prohibited unless authorised in writing or permitted by law.

9. Complaints and mediation

For an order or access issue, first use the contact form. For administrative questions concerning the seller: bruxelles@smart.coop. If no amicable solution is found, consumers may consult the Consumer Mediation Service or ConsumerConnect.

10. Applicable law

Belgian law applies without depriving a consumer living in another country of mandatory protections available to them. Statutory jurisdiction rules, including those protecting European consumers, remain applicable.

11. Official Productions Associées terms

The English Productions Associées general terms and their French version, supplied through the Smart Guide, supplement this information where applicable to the order. In the event of conflict, mandatory consumer protection law prevails.
